Human
Rights in Iran – On Tuesday, March 31st, 2020 Danial Zeinolabedini,
a juvenile criminal imprisoned in Mahabad Prison who had been transferred to
solidarity cell for participating in protests against a lack of accessibility to
hygiene and disinfection products passed away after assault and battery and
torture by security agents in prison.
According to Human Rights in Iran quoting from Amnesty International on Sunday, March 29th, 2020 after prisoners of Mahabad prison protested for lack of access to hygiene
and disinfection products and inappropriate situation of prison from the point of
hygiene to avoid them get infected by Corona Virus and also being deprived of
the right to go temporary leave and civil rights. Danial Zeinolabedini, a
juvenile criminal born on August 19th, 2000 and imprisoned in
Mahabad Prison, convicted of “homicide” after being sent to solidarity passed
away due to assault and battery be security guards and agents.
According to this report, Danial Zeinolabedini, after protests in Mahabad Prison on March
29th, 2020 was transferred to solidarity cell and then transferred
to Miandoab Prison and there, was subject of assault and battery and violent
behavior.
Danial’s family declared: “on contact, he made on March 31st, 2020 mentioned
due to hard assault and battery, he has difficulty breathing and needs to
receive healthcare and just two days later, on April 2nd, 2020 it
was announced to them he has passed away.”
He was convicted of murder in November 2018 and sentenced to death, which has been
approved by Islamic Republic High Court, while he insisted, he was innocent and
not plead guilty. It is necessary to bear in mind that, according to The United
Nations Convention on the Rights of the Child, at the
time the homicide happened Danial was under 18 years of age, i.e. he amounted
as a child and executing to sentencing him to death for a crime in that age is in
compliance with international measures, but the Islamic Republic Judiciary system
in these cases, keep them in prison until they fulfill the age requirement and
then execute them. The main reason is that according to the Islamic Penal Code, a child is someone under the religious mature age i.e. 15 lunar years for boys (almost
13 years of the solar calendar) and 9 lunar years for girls (almost 8 years of
solar calendar) and after that, they have criminal reliability, even though
the law in Iran has forbidden executing anyone under 18 years of age and judges
avoid that.
In the last weeks by spreading the Corona Virus and a large number of infected people,
especially among prisoners because they have to live in groups and their
deprivation to hygiene products and lack of other healthcare services and
products, a huge wave of protests and dissatisfactions took place in different
prisons in Iran.
